Last night, Andrew Finch, a 28 year old man in Wichita, was
shot dead by police after they received a false call about a
home invasion, a call that appears to have originated with
Tyler Raj Barriss, a 25-year-old Los Angeles man whose gamer
handle was "SWAuTistic," and who was later arrested by LAPD on
a fugitive warrant stemming from bomb threats he phoned in to
ABC7, an LA police station. Barriss has a long history of
swatting and threats to swat. The swatting seems to have been
the result of a disagreement among two Call of Duty teammates
after a loss in an online match that had a $1.50 wager riding
on it.

Just to be utterly clear on this - the guy who called in the SWAT team
didn’t pull a trigger. Saying he committed murder is surely not going to
stand up in court. The person with their hand on the gun was a police
officer who shot and killed an innocent person without any justification.
The US needs to consider why it in effect has an armed militia going around
prepared to kill people on the say-so of a phone call.

IANL, but this kind of criminal charge is routine, and usually stands up in
court:

An acquaintance from my childhood is currently serving life in prison for a
situation very similar to what is outlined in the definition above. This
doesn't absolve the cop who pulled the trigger, but it isn't even necessary
to convict the cop of murder before convicting the hoaxer of felony murder.

In the UK this is known as “joint enterprise” - the getaway driver of the
gang where one kills the cashier (pause: why didn’t that apply in a recent
film about a driver? Anyway).

I think it is harder to apply in this case. Did the caller *know* that what
he was doing would likely result in death? The gap between what he did -
make a call - and what happened couldn’t be predicted, unlike a getaway
driver for a robbery.

And nobody is asking questions about the actions of the police? I’m
astonished by that.

46 states have a “felony murder” statute — anyone who is involved in committing a serious felony that results in the death of someone can be charged with murder.
Kansas has such a law. I think false reporting is a felony, but I do not know if it would be a significant felony as regards a felony murder charge. If so, Mr. Finch could potentially be charged with murder, and it would likely stand up in court.
Note that I do not know Kansas law on this, nor am I a lawyer, but I am familiar with the general concept. You can also find references online.
“Swatting” should be a felony in all states, IMO, although some only treat it as a misdemeanor.
